Workshop Terms and Conditions

By registering for an Andrew Hertel Photography workshop, expedition, or program, you agree to the following Terms and Conditions. These Terms and Conditions may be updated or amended from time to time, and it is the participant’s responsibility to remain familiar with the most current version.

Acknowledgement of Risk

Participation in an Andrew Hertel Photography workshop or expedition involves activities that take place outdoors and often in remote or rugged environments. These environments may include deserts, mountains, wilderness areas, coastal terrain, and other natural settings where conditions can change quickly.

Participants acknowledge that outdoor travel and photography activities may involve risks including, but not limited to:

  • uneven terrain

  • extreme weather conditions

  • wildlife encounters

  • remote locations with limited access to medical care

  • transportation hazards

  • physical exertion associated with hiking or exploration

By registering for a workshop or expedition, participants acknowledge these inherent risks and voluntarily accept full responsibility for their participation.

Participants agree that they are physically capable of participating in the activities involved and will exercise reasonable judgment to ensure their own safety.

General Terms

By attending an Andrew Hertel Photography workshop or expedition, you acknowledge and accept certain risks associated with travel and outdoor activities.

Your registration serves as a release of liability and a complete assumption of all risks by you and your heirs, administrators, executors, successors, and assigns for all family members participating in the program.

You acknowledge that travel and outdoor activities may involve inherent risks including, but not limited to:

  • injury

  • illness

  • death

  • loss or damage to personal property

These risks may arise from acts of nature, terrain conditions, mechanical issues, negligence of others, or other unforeseen circumstances.

Participation in an Andrew Hertel Photography workshop or expedition is entirely voluntary, and participants assume full responsibility for their participation.

Vehicle Responsibility (Applicable to Motorcycle or Vehicle-Based Expeditions)

Participants are responsible for ensuring that any motorcycle or vehicle used during the workshop or expedition is in safe and proper operating condition prior to the start of the trip.

Andrew Hertel Photography is not responsible for mechanical failures, breakdowns, or delays resulting from vehicle issues.

Participants are responsible for their own vehicle maintenance, repairs, and associated travel logistics.

Remote Environment Acknowledgement

Some workshops and expeditions take place in remote locations where medical services, cell phone coverage, fuel availability, and other services may be limited or unavailable.

Participants acknowledge that access to emergency services may be delayed and accept the risks associated with travel in remote environments.

Participants are responsible for ensuring they are physically capable and properly equipped for the conditions of the workshop or expedition.

Participants are encouraged to carry appropriate safety equipment when traveling in remote environments, including personal emergency communication devices such as satellite messengers (Garmin inReach, Zoleo, or similar) where appropriate.

Booking and Deposits

A non-refundable deposit is required to secure your place on a workshop or expedition.

Deposits are non-refundable, however they may be transferred one time to the deposit of another Andrew Hertel Photography workshop if the participant cancels their original booking.

Transferred deposits must be applied within 12 months of the original workshop date and are subject to availability in the requested workshop.

Only one transfer is permitted per deposit.

The remaining balance of the workshop fee is due 90 days prior to the workshop start date.

Bookings made within 90 days of the workshop start date must be paid in full at the time of booking.

Cancellations and Refunds

Due to the logistical planning and financial commitments required to organize workshops and expeditions, the following cancellation policy applies.

All cancellation requests must be submitted via email.

Participants are strongly encouraged to purchase trip cancellation insurance to protect themselves in the event of unforeseen circumstances that prevent attendance.

Cancellation policy:

More than 90 days prior to the workshop start date
Refund of monies paid minus the $500 deposit.

89–31 days prior to the workshop start date
Refund of monies paid minus the $500 deposit and $200 administrative fee.

30 days or less prior to the workshop start date
No refund of any monies paid.

If a participant cancels and their spot can be filled by another participant, Andrew Hertel Photography may refund payments made minus the $200 administrative fee.

Workshop Cancellation by Organizer

Andrew Hertel Photography reserves the right to cancel any workshop or expedition if the minimum number of participants is not met or if circumstances make the workshop impractical to operate.

If a workshop is canceled by Andrew Hertel Photography, participants will be given the option to:

  • transfer to a future workshop

  • receive a full refund of payments made

Andrew Hertel Photography is not responsible for additional expenses incurred by participants including, but not limited to:

  • airfare

  • accommodations

  • equipment rentals

  • transportation costs

For this reason, travel insurance is strongly recommended.

Force Majeure

Andrew Hertel Photography shall not be responsible for cancellations, delays, or itinerary changes resulting from events beyond reasonable control, including but not limited to:

  • weather conditions

  • natural disasters

  • government restrictions

  • transportation disruptions

  • illness outbreaks

  • political instability

  • road closures or access restrictions

Workshops may be modified or adjusted as necessary to ensure participant safety.

Insurance

Participants are strongly encouraged to obtain travel insurance that covers trip cancellation, delays, interruptions, medical emergencies, and evacuation if necessary.

Andrew Hertel Photography is not responsible for any loss, damage, injury, or medical expenses incurred during the workshop or expedition.

Participants attend all workshops and expeditions at their own risk.

Participants traveling internationally should verify with their healthcare provider whether their insurance covers medical care abroad.

Health and Safety

Participants are responsible for ensuring that they are in good health and physically capable of participating in workshop activities.

Participants should inform the workshop organizer of any relevant medical conditions at the time of booking.

Andrew Hertel Photography reserves the right to refuse participation or remove a participant from the workshop if it is determined that participation may pose a risk to the participant or others.

Participants are expected to arrive prepared with the appropriate equipment, clothing, physical conditioning, and skill level necessary for the activities involved in the workshop or expedition.

Andrew Hertel Photography reserves the right to decline or remove a participant from an activity or from the workshop entirely if it is determined that the participant is not adequately prepared, lacks the necessary skills, or poses a safety risk to themselves or others.

In such cases, refunds will not be issued.

Itinerary and Changes

Workshop itineraries are subject to change due to:

  • weather conditions

  • safety concerns

  • local circumstances

  • logistical considerations

  • other unforeseen factors

While every effort will be made to follow the advertised itinerary, Andrew Hertel Photography reserves the right to modify locations, schedules, and activities as necessary.

Conduct

Participants are expected to behave in a respectful and responsible manner throughout the workshop.

Participants must:

  • respect local communities and customs

  • respect wildlife and the natural environment

  • follow the instructions of the workshop leader and any local guides

  • treat fellow participants with courtesy

Andrew Hertel Photography reserves the right to remove any participant whose behavior is deemed disruptive, unsafe, or harmful to the group. No refunds will be issued in such cases.

Media and Image Use

During the workshop or expedition, photographs or video may be taken that include participants.

By participating in the workshop, you grant Andrew Hertel Photography permission to use images or video captured during the workshop for promotional, educational, or marketing purposes unless you request otherwise in writing prior to the start of the workshop.

Limitation of Liability

Andrew Hertel Photography, its instructors, assistants, contractors, and affiliates shall not be held liable for any personal injury, illness, loss, damage, delay, or inconvenience arising from participation in the workshop or expedition.

Participants agree to assume full responsibility for their actions and decisions during the workshop.

Participants may be required to sign an additional liability waiver and release of claims prior to the start of the workshop or expedition.
